The Association of Owners of Empuriabrava, which was recently established in order to defend the rights of the owners of properties and moorings in Empuriabrava, is working together with the Association of Tourist Businesses, “Tot Comerç”, to make public the extent of the matter initiated by the concessionaire, and at the same time has contacted various legal services with the aim of obtaining a legal report elaborated by lawyers, legal and independent professionals that will serve as a base for future actions and decisions made by owners and businesses in defense of their own interests in the mentioned process.

Until we have this legal report, we have elaborated a preliminary report that summarizes our opinions and concerns, and we expect the collaboration of all the interested parties in order to circulate it as much as possible.

IMPORTANT & URGENT

Ask for your letter of formal objection against the Act of Apeo/demarcation held on 29th September to 2nd October, 2008.

We request that you print out the attached document, fill out your personal details where indicated on the first page, sign it at the bottom, keep a copy for your own records, and send the original by post, RECORDED DELIVERY with acknowledgement of receipt, to the “Servicio de Costas” whose address is detailed below. Please ensure to do this BY SATURDAY, 18th OCTOBER, 2008.

For letters sent within Spanish territory, please request at the Post Office that they stamp a copy “Correo Administrativo”.

For letters sent from abroad, please keep a copy together with the proof of recorded delivery.

It is also possible to hand in the original to the offices of the Association in order that we may send the document on your behalf, but if this is the case, we must have received your document BEFORE FRIDAY, 17th OCTOBER, 2008.

We would be grateful if you could send us a copy of the first and last pages, once presented, by e-mail or fax, so that we can file it in our data base.

IMPORTANT: The model of the formal objection is general, intended for “normal” houses/properties on the canal.

In the following cases, we request that you contact us by e-mail or telephone from Monday onwards, as there is a specific document for defending your Rights:

• Ownership of moorings in a private port, Joint ownership of land dedicated to a private port, all of which are reflected in a Public Notary Deed.
• House on the canal with a jetty (private port/boathouse) within the boundaries of the Plot
• House on the canal whereby the neighbour has a jetty (private port/boathouse) within 6 metres of the boundary of your plot
• House on the canal that has a canal on 2 or more boundaries

for the moment, say NO!

If you sign or provide documentation on moorings or properties in Empuriabrava to the concessionaire “Port d’Empuriabrava, S.A.” or to any other company connected with them, it may result in serious consequences on your rights on properties and/or moorings. Get informed before you sign!
